Dear Readers,

 

Necessity is the mother of invention—or, to paraphrase Victor Hugo, no one can resist an idea whose time has come. After spending many hours tracking down information and materials, from many different sources, we decided it was time for a change. We gradually began to create our own base of arbitration know-how that we needed to draw upon in order to carry out our work for clients. Finally the concept was born to combine all these items into a single tool. The result was an intranet that we use in our daily law practice. However, we decided that our effort would not be put to the best use if we reserved this resource for our own use alone. Thus a great honour for us would be if our portal were also used by our colleagues—other lawyers—as well as judges, scholars, law students, and anyone else with an interest in the area. We believe that the portal will help spread knowledge about arbitration and about the concept of arbitration as a method for resolving disputes.

In the portal you will find first a database of judicial decisions, beginning from rulings by the Polish Supreme Court in the 1920s down to the present, updated regularly, a bibliography of Polish publications on the subject of arbitration, the current and historical wording of arbitration regulations in Poland, and an English translation of Polish arbitration law currently in force.

Another objective is to provide interesting publications here concerning arbitration. We start out with a few items, including an article by Louis B. Buchman entitled “How to Select an Arbitrator?” You will also find our own publications, one of which so far, “The Form for Correction and Interpretation of an Arbitration Award,” is published here for the first time. Other publications that are available include articles published in earlier issues of the quarterly ADR. ArbitraĆŒ i Mediacja (ADR: Arbitration and Mediation).

You will also find links here to websites of permanent arbitration courts and other important institutions related to arbitration in Poland and around the world. Many of them offer free access to publications and other information of interest.

These resources are supplemented by news and information about current events related to arbitration in Poland and internationally.

A few words of thanks are in order. Firstly, to our clients: by entrusting us with their arbitration matters, they provided us the motivation, and thus created the need, for creation of this tool.

Special thanks also go the team of young lawyers in the Dispute Resolution Practice Group at our law firm, who prepared the portal under the direction of legal adviser Agnieszka Kocon, who serves as the editor of the portal.
